A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks legal authority.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.

The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face human smuggling charges, he was held in federal detention.

In her order, the court noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court challenge center on disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing trial in Tennessee.

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
